On September 4, 2015 at 5:01 pm Officers of the Frederick Police Department were in the area of 50 Carroll Creek for complaints of alcohol and drug use.
OFC Gunder of the Directed Patrol Team observed a male, later identified as Brian Lewis (DOB 7-11-1961) with an alcoholic beverage. OFC Gunder placed Lewis under arrest for possessing an intoxicating beverage in a public park. Search incident to arrest, suspected synthetic cannabinoid was located in his pants pocket.
During the arrest, Lewis yelled profanities and continued to scream. He was given numerous orders to prevent a disturbance. Lewis disregarded all orders by OFC Gunder. Lewis then began screaming and banging on a glass window to a business. Lewis pulled away from OFC Gunder and tried to leave the scene.
OFC Gunder and Lewis began struggling and Lewis was taken to the ground. A passerby, observing the struggle, stopped to assist OFC Gunder. The citizen and OFC Gunder were than able to get control of Lewis until other Officers arrived on scene. OFC Gunder sustained minor injuries to both hand and was treated on scene by EMS.
Lewis was transported to FCADC for processing.
