[ARCHIVED] Frederick Police Department Makes Arrest for 1st Degree Assault/Burglary, CR15-067903

Frederick, MD. - On 8-20-2015 at around 1:15 PM, Officers were dispatched to the area of Orchard Way and Hill Street for a report of an assault in progress. Upon arrival OFC Inman observed 2 subjects attempting to flee the area. OFC Inman apprehended Jose Cubias and broadcast a description the second subject who was later apprehended after a foot chase with police. The second subject was identified as Jose Boj. During the course of the investigation it was uncovered that both Cubias and Boj went to the front door an apartment and began banging on the door with knives in their hands. The victim refused to open the door and said that he then noticed that both Cubias and Roj had climbed onto the balcony on the second floor of the apartment. The victim advised that they were then pounding on the sliding glass door, attempting to get into the apartment. Cubias and Roj then threw the victim’s bike off the balcony, ultimately damaging it. The victim then went to confront Cubias and Roj as they were taking his bike away from the area. As the victim confronted them both Cubias and Roj again pulled out knives and threatened to kill him. It was noted that Cubias put a knife directly to the victim’s throat and made a throat cutting motion. Bystanders then intervened and helped remove the victim from danger before he was harmed. Both subjects were placed under arrest and searched incident to arrest. A knife fitting the description from the victim was located on Cubias. Boj and Cubias were transported to the Frederick County Adult Detention Center for processing.
