INCIDENT/ INFORMATION:
On Monday December 26, 2011 at approximately 1258 hours OFC Putman of the Frederick Police Department responded to the 100 block of North East Street for the report of a disorderly subject. Another off duty officer witnessed a male, later identified as Spivey, James Lincoln, tearing down Christmas decorations in that area. OFC Putman located the subject in an establishment in the 100 block of North East Street, causing a disturbance within. OFC Putman escorted Spivey from the establishment where he was placed under arrest for disorderly conduct. Spivey repeatedly identified himself as Charles Wesley to OFC Putman. As Spivey was being processed by central booking personnel fingerprints confirmed Spivey’s true identity. Spivey was also wanted out by the Howard County Police Department for failing to properly register as a sex offender. OFC Putman had already secured for the day so Spivey was charged by OFC Auge under his correct name, at which time he was also served the warrant from Howard County. At the time of the press release Spivey was currently awaiting a hearing before a district court commissioner.
