On 02/03/13 at 1503 hours Officer Meyer was on patrol in the area of the 400 block W. South Street. Officer Meyer traveled into an apartment complex parking where he observed a driver sitting in a vehicle. The driver then stared at his police vehicle for a brief moment and sped out of the parking lot on to W. South St. A traffic stop was initiated on WV DNS423 because the vehicle did not stop before entering a public road from a private drive. As the officer was speaking with the driver he appeared visibly nervous: body shaking, voice stuttering and he also presented a credit card to the officer instead of his driver’s license. Officer Brown arrived as back up and was observing the driver through the passenger’s side window as Officer Meyer returned to his vehicle to run the driver through the computer system. Officer Brown observed the driver open the center console and begin to eat small objects. Officer Brown ordered the driver to stop eating and exit the vehicle. Officer Meyer returned to the driver’s vehicle and observed off white crumbs that appeared to be suspected crack cocaine in the cup holder that the driver was eating from. The driver was placed under arrest. A search of the driver resulted in no additional evidence. Numerous items of suspected CDS paraphernalia were located in the vehicle when it was searched incident to arrest. The driver was transported to central booking for processing.
